Rhode Island has plans to officially sign online casinos into law and launch its online casino program in March 2024. Other states are working on similar legislation, but none are close yet to having the rules, the platforms, or a start date set in stone.

Federal Legislation of Online Casinos

Over the past fifty or more years, there have been several federal laws that have stood in the way of readily available online gambling becoming a legal reality in the United States. A few of these laws remain in the books, but PASPA was overturned in recent years and paved the way for legal sports betting to take hold in about half the states as of 2023.

We’ll look at these three significant laws and how they impact the US online casino market today. The legal landscape of gambling and betting apps in the United States is super interesting; there are several loopholes and exemptions in these laws and different ways to interpret what they say that have led to some exciting developments in favor of legal online gambling in certain states.

Professional and Amateur Sports Protection Act

There used to be a law in the United States called the Professional and Amateur Sports Protection Act, abbreviated to PASPA and colloquially known as the Bradley Act. It was introduced and passed into law in 1992 and was meant to define the legal status of sports betting in the United States. For years, sports betting was outlawed in the United States, both in-person and online (with a few grandfathered exceptions). 

PASPA was found unconstitutional by the US Supreme Court in 2018 in a 6-3 decision, citing that the law took power away from the states to establish their laws regarding sports betting in-person and online. Once PASPA was overturned, many states began working on passing legislation to get sports betting legalized.

Unlawful Internet Gambling Enforcement Act

The Unlawful Internet Gambling Enforcement Act was passed in 2006. It was one of the more considerable roadblocks to overcoming the problem of getting online casino apps legalized in the United States. This law made it illegal for financial institutions to process transactions related to online gambling, which included sports betting and online casino games.

Even though UIGEA still holds today, there are exceptions granted to certain entities; any state that passes sports betting or gambling legislation and ushers in USA-regulated online casinos or sportsbooks into their state is granted an exception from UIGEA because this federal law must defer to state law. This is how casino apps offered by Caesars, BetMGM, or DraftKings can get around this 2006 law. UIGEA is only held in states that haven’t passed their legislation regarding gambling or sports betting.

Federal Wire Act

This is an older law dating back to 1961 and the Kennedy administration. This federal law is still on the books. It prohibits certain kinds of gambling businesses in the United States but has widely been interpreted to relate only to sports betting.

When you read what the law says, you’ll find the following:

“Whoever being engaged in the business of betting or wagering knowingly uses a wire communication facility for the transmission in interstate or foreign commerce of bets or wagers or information assisting in the placing of bets or wagers on any sporting event or contest, or for the transmission of a wire communication which entitles the recipient to receive money or credit as a result of bets or wagers, or for information assisting in the placing of bets or wagers, shall be fined under this title or imprisoned not more than two years, or both.” 

As this law was drafted and signed into federal law in 1961, a time before the Internet was made widely available, the specific mechanism acknowledged here was the wire transfer of funds following a sporting event or contest. In 2002, the Department of Justice put out an opinion to spin this law into applying to sports betting and casino games on the Internet, even though online wire transfers and sports bets/contests are mentioned. The law itself is called the “Federal Wire Act.”

The Federal Wire Act is still on the books, but it was drafted in an entirely different time. People who interpret law have tried at times to shoehorn it into the modern context and apply it to online gambling today, even though federal law in this realm must yield to state law. The Federal Wire Act is an outdated law that pretends to have clout when it comes to online gambling but is a product of another time that refers to something else entirely.

States That Have Legalized Online Casino Apps

With a few old laws, red tape, and legal roadblocks out of the way, you’d think casino apps would be legal across the entire United States. But that’s not the case. Each state has to draft and pass its laws and regulations to get online casino gaming or sports betting set up. Just ask Phil Murphy and the lawmakers of 2018 New Jersey about it; they were the pioneers of moving this stuff along, and it was hard work!

While about half of the states have passed laws to legalize sports betting, online casinos have been a bit slower going, with only six turning the trick:

The only state that’s worth talking about at this time is Rhode Island, which has laws for online casino gambling in place. They are scheduled to launch officially in March 2024. RI became the seventh state with legal online casinos when Governor Dan McKee signed S948 and H6348 into law in the summer of 2023.

Rhode Island will be working in partnership with Bally Casino and International Gaming Technology (IGT). They’re expected to offer various exciting games like digital slot machines, blackjack, and poker tables. The state gets 61% of all revenue from slots and 15.5% from all table games. Unlike the other six states that have passed online casino legislation post-PASPA, Rhode Island requires all Bally Casino online table games to be overseen by a live dealer.
